Is it Possible to get Legal Aid for a Divorce When on Benefits?

Up until April 2013, if you were on benefits you had an almost automatic right to Legal Aid for all kinds of legal issues, including arguments over money and children during divorce. Now, only litigants who are seeking a divorce because of domestic abuse or who need to end a forced marriage will qualify for legal aid.

Therefore, the answer to the question, ‘Is it possible to get legal aid for a divorce when on benefits?’ is ‘Yes, but only if you are trying to end a seriously abusive relationship’.

It is important to understand that the abuse need not be physical. It can be psychological, sexual, financial or emotional.

Can Those On Benefits Still Afford a Divorce?

If you are on benefits, need a divorce and do not meet the criteria, there is no need to despair. If you have grounds for a divorce and your partner is not going to contest it, you can do your own drafting of the legal documents and file for divorce that way. You can find out everything you need to know about doing this on our website. You will see free divorce documents that you can download,

If you are still confused, talk to us and we will guide you through the process. Using our pay as you go service, you will only be charged when we handle anything you do not feel comfortable handling yourself.  Uncontested divorces do not end up in court, which means most people can handle their own divorce with very little guidance from us.

Of course should you want us to, we will handle the entire divorce process and do so for a fixed fee. Our fees are exceptionally low.

If your divorce is more complex and you do need to go before a judge we can still help. You can represent yourself in court as a litigant in person, which will keep your costs down. Once again, we will provide support and advice only when you need it, to keep how much you pay us to a bare minimum.

At Hylton-Potts, we can help you to get your divorce even if you are on benefits and on a tight budget.
