Can I divorce my husband who is living in Spain using the UK courts?

Question: About a year ago, my husband moved to Spain for work. The plan was for me to join him, but after a while, I began to feel that I could not trust him. For me the relationship was over and I no longer wanted to move countries to be with him. My husband has now decided that he wants to stay in Spain.

I now want a divorce, but do not want to have to go to Spain to get one. Can I get a divorce through the British courts without him coming back to the UK?

Answer: It is possible to get a divorce through the British courts without your husband coming back to the UK. You just need to prove that you are legally resident in the UK and be here while the divorce goes through the courts. However, the process may take about three weeks longer than a divorce where both parties are currently resident in the UK.
