I got married in India, can I get divorced in the UK?

Question: I am Indian, by birth, and married in India. My wife and I now both want a divorce, but I live here, and she still lives in India. Ideally, I would like to get my divorce without having to return to India. Is this possible? Our affairs are quite straightforward, there are no issues surrounding children, property or money.

Answer: Provided your marriage is legally recognised in the UK, you can end it using the UK court system. You will have to demonstrate that you are domiciled in the UK for the court to have jurisdiction in this matter.

Most countries recognise each other’s divorce and marriage documentation. However, in most cases other countries require the documentation to be properly notarised. They normally also require the documents to be translated by a professional translator. Sometimes these documents will have to be certified by the embassy in the country in which the marriage took place.

Before proceeding, you need to seek legal advice about your specific case. You need a lawyer to look at your case in its entirety, so that they can tell you the exact process you must follow for your specific case.
