Pre-nup and adultery

An article in The Times 24th July 2015 page 7 www.thetimes.co.uk is well worth a look.

If you worry about temptations facing your fiancée, after marriage consider a prenuptial contract with a fidelity clause. This means that if either partner is unfaithful they will lose much of their share of any divorce settlement.

Rodney Hylton-Potts one of London’s most prominent divorce lawyers, said that adultery clauses were now a common feature of pre-nuptial agreements. They have yet to be upheld in British courts, however, and the idea of identifying fault in divorce cases runs counter to the trend in courts to avoid assigning blame for a marriage break-up, but may well be enforceable,

Adultery clauses are at the forefront of terms that couples wanted to agree before marriage. One even had a clause giving the wife nothing, if she put on more than 2 kilos

Experience shows that the most efficient and experienced fixed fee solicitors and lawyers are in London, despite extra overheads.

The Central Family Court, previously the Principal Registry in London is more suitable, especially for wives, for complex or middle and upper-class divorces. The judges are far use to what other County Court might consider to be ‘high’ awards of capital and maintenance.

London judges in particular are very experienced and sophisticated when it comes to investigating assets, especially overseas companies and trusts, and anecdotally especially for wives.

London has been called the wife’s divorce capital of the world.
