The Tom Cruise/Katie Holmes custody announcements reveal far more on close examination.
- Katie was successful in “forum shopping” in choosing a New York judge who is more likely to raise serious concerns about Scientology than the more liberal, relaxed judges of Los Angeles.
- Any Prenuptial Agreement can to be set aside if there is serious misrepresentation. That is the risk Tom was taking if Katie could show he had withheld from her key information that could adversely affect the upbringing of their six-year-old daughter, Suri. His attachment to their military wing is a case in point
- The glowing tributes to Tom’s lawyers by Katie’s are part of a face-saving private deal, because clearly they backed down big time.
- The court documents will say joint and equal custody, but there will be a very private agreement whereby Suri is kept away from Scientology, and Katie controls education.
- Each party expressed respect of for each other’s commitments and beliefs and support each other’s roles as parents, but what is missing is the respect for the other’s right to bring up the child. A clear clue to what happened during negotiations.
- The more that emerged of the Scientology angle, the more anxiety amongst the Hollywood studio bosses. He was told to get the deal done.
