The legal situation of couples living together, which more and more people do outside marriage, is our area.  What we recommend is a contract setting out who owns what, and who gets what.

A big mistake that people make is hoping the problem will take care of itself. Well it won’t, and then you have a situation where you break up, which does happen, and there’s a horrendous row about who paid for what, or who should own what, and whose name it’s in and there are rows involving the property and often, and increasingly, children, and it’s desperately sad when you have a situation where children and money mix, and bitterness follows.  If you can have a framework to stop rows over the money, that helps that situation.

Our experience is that you’ve signed the thing, (it’s not very romantic but it’s sensible), stick the thing in a drawer and hopefully you’ll never have to take it out.  If you do have to take it out, it gives you a framework for ending the relationship in a fair and dignified way, buying the other out of the property, some option like that, furniture, who paid for what.
