Threat of Prosecution Dropped and Administrative, Civil Penalty Offered
Hylton-Potts - London Based Law Firm Helping People Across the UK since 1999
The fraud authorities have discretion to offer a civil administrative penalty of up to 50% (but often 20 to 30%) of the overpayment, rather than prosecute. We are experts at convincing the decision maker to take this course.
We have had many good results and here is a recent example:
Mr G took a job in a bar, while collecting Housing Benefit and Council tax. He was called for an interview under caution. We do not allow our clients to attend and we said in a written statement, along with character references and a medical report.
The result was that the decision maker decided not to prosecute and to offer an administrative civil penalty. There was no prosecution and no criminal record
